Welcome to Love Mind Coach! These Terms of Service ("Terms") govern your use of our coach recruitment platform and services. By submitting an application or using our platform, you agree to these Terms.

1. Acceptance of Terms

By accessing our website, submitting a coach application, or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

To apply as a coach on our platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Provide accurate and complete information in your application
• Have relevant experience or qualifications in relationship coaching, counseling, psychology, or related fields (subject to verification)

3. Application Process

Submission:

• When you submit an application, you consent to receive transactional emails regarding your application status
• You may optionally consent to receive marketing communications about coaching opportunities
• All information you provide must be accurate, current, and complete

Review:

• We review all applications but make no guarantee of acceptance
• We reserve the right to accept or reject any application at our sole discretion
• The application review process typically takes 3-5 business days

Background Checks:

• Accepted coaches may be required to undergo background checks and verification
• You authorize us to conduct such checks as part of the onboarding process

4. Coach Agreement

If your application is accepted, you will enter into a separate Coach Services Agreement that will govern:

• Your coaching responsibilities and standards of conduct
• Payment terms and compensation structure
• Scheduling and availability requirements
• Client confidentiality and professional ethics
• Liability and insurance requirements

5. Email Communications

Required Communications:

• By applying, you consent to receive transactional emails about your application
• These may include application confirmations, status updates, and onboarding information
• You cannot opt-out of transactional emails, but you may contact us to withdraw your application

Marketing Communications:

• Marketing emails are optional and require your explicit consent
• You can unsubscribe from marketing emails at any time
• Unsubscribing from marketing emails will not affect transactional communications

6. Independent Contractor Relationship

Coaches accepted onto our platform are independent contractors, not employees of Love Mind Coach. This means:

• You set your own schedule and rates (subject to platform guidelines)
• You are responsible for your own taxes and legal compliance
• No employment benefits are provided
• You maintain control over how you provide your coaching services

7. Professional Standards

Coaches are expected to:

• Maintain professional and ethical conduct at all times
• Respect client confidentiality and privacy
• Provide quality coaching services
• Comply with all applicable laws and regulations
• Maintain appropriate professional boundaries
• Continue professional development and training

8. Prohibited Conduct

The following activities are strictly prohibited:

• Providing false or misleading information in your application
• Engaging in harassment, discrimination, or abusive behavior
• Soliciting clients outside the platform without authorization
• Sharing confidential platform information or client data
• Violating any laws or regulations
• Impersonating another person or entity

9. Intellectual Property

Platform Content:

• All content on our website and platform (logos, text, graphics, code) is owned by Love Mind Coach
• You may not copy, modify, or distribute our content without permission

Your Content:

• You retain ownership of any content you create (coaching materials, profiles)
• By using our platform, you grant us a license to use your content for platform operations and marketing

10. Fees and Payments

Details about platform fees, payment processing, and coach compensation will be provided in the Coach Services Agreement. Generally:

• Coaches set their own rates subject to platform guidelines
• Love Mind Coach may charge a platform fee or commission on sessions
• Payment terms and schedules will be clearly outlined
• Coaches are responsible for applicable taxes

11. Termination

By You:

• You may withdraw your application at any time before acceptance
• Once onboarded, you may terminate your coach agreement per the terms outlined in the Coach Services Agreement

By Us:

• We may reject or terminate any application or coach account at our discretion
• Reasons for termination may include violation of these Terms, poor performance, or professional misconduct
• We will provide notice when reasonably possible, except in cases of serious violations

12. Disclaimers and Limitation of Liability

Platform Availability:

• We strive to maintain platform availability but do not guarantee uninterrupted service
• We are not liable for service disruptions or technical issues

Limitation of Liability:

• To the maximum extent permitted by law, Love Mind Coach is not liable for indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim

No Guarantees:

• We make no guarantees about client volume, income potential, or business success
• Individual results will vary based on many factors

13. Indemnification

You agree to indemnify and hold harmless Love Mind Coach from any claims, damages, or expenses arising from:

• Your use of the platform
• Your coaching services
• Your violation of these Terms
• Your violation of any laws or third-party rights

14. Data Protection and Privacy

Your use of our platform is also governed by our Privacy Policy, which explains:

• How we collect and use your personal information
• Your rights regarding your data
• Our security measures and data retention practices
• Compliance with AWS SES email sending requirements

15. Dispute Resolution

Informal Resolution:

• We encourage you to contact us first to resolve any disputes informally

Governing Law:

• These Terms are governed by the laws of California, United States
• Any legal actions must be brought in the courts of Los Angeles County, California

Arbitration:

• Most disputes shall be resolved through binding arbitration rather than in court
• You waive your right to participate in class action lawsuits

16. Changes to Terms

We may modify these Terms at any time. When we do:

• We will post the updated Terms on our website
• We will update the "Last Updated" date
• For material changes, we will notify you via email
• Your continued use of the platform after changes constitutes acceptance

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any Coach Services Agreement, constitute the entire agreement between you and Love Mind Coach.

19. AWS SES Compliance Requirements

To maintain compliance with Amazon Web Services Simple Email Service (AWS SES) requirements:

• All emails sent through our platform comply with CAN-SPAM and anti-spam regulations
• We maintain clear opt-in mechanisms for marketing communications
• All marketing emails include visible unsubscribe options
• We honor unsubscribe requests within 48 hours
• We monitor and maintain low bounce and complaint rates
• Transactional emails are clearly identified and separated from marketing content
